Charity & Social Enterprise

Charities are facing funding pressures, increasing regulation and greater scrutiny which require them to adapt.

Following numerous scandals over the past decade, governance in the charity sector has been under intense scrutiny from both a regulator keen to demonstrate its effectiveness and the public whose trust in charities has been undermined. All charities must be aware of their legal obligations and stay abreast of changing legal requirements to avoid potential regulatory intervention and the consequences it can bring.

The role of trustees is also under scrutiny and many charities are undertaking extensive reviews of their governance, making use of new tools such as the Charity Governance Code to ensure compliance with charity law and principles of best practice. While trustees bring invaluable experience and knowledge, they are not immune from criticism and scrutiny when things do not go to plan.

Many charities have also been hit by public funding cuts and are facing significant pension deficits. This has led some to diversify as they look to additional or alternative income streams and to merge or otherwise collaborate to take advantage of greater economies of scale. At the same time, charities are playing an increasing role in public services.

To stay efficient and compliant in this rapidly evolving landscape, charities need a partner who can help them navigate legal matters.
