Our charity lawyers provide legal guidance during regulatory concern and statutory inquiries, whether by the Charity Commission or another regulator.
The Charity Commission, in particular, is keen to be viewed as robust and effective in its approach to regulating the third sector. Amid increasing use of its compliance-related powers, ever more charities are finding themselves the subject of statutory inquiries by this regulator.
We help such charities access the support and guidance that they need during stressful times. We provide advice throughout Charity Commission investigations, including regulatory concern cases and statutory inquiries.
Several of our specialist charity lawyers bring first-hand experience from legal and regulatory roles at the Charity Commission. We're perfectly placed to guide trustees through the complexities of an investigation, respond to lines of enquiry and manage any requests for information.
Crucially, our support doesn’t end with the conclusion of a case or investigation. We also assist trustees to effectively implement the action plans and governance recommendations issued by the Charity Commission to ensure ongoing compliance and long-term peace of mind.

We understand just how tough it can be for a charity to continue operating while cooperating with a regulatory investigation. With our full support, trustees can be assured that their case is being expertly handled by a team that’s committed to achieving the best possible outcome.
As well as assisting charities in their dealings with the Charity Commission, we recognise that many charities are often subject to additional regulation — for example, from Companies House, the Care Quality Commission or Ofsted. We have experience in dealing with a vast number of regulators on behalf of all types of charities. This helps us to recognise the specific requirements of each regulatory body and tailor our advice accordingly.
We also act for a number of exempt charities who aren’t required to register with the Charity Commission — instead being regulated by another principal regulator such as the Office for Students or the Regulator of Social Housing. These charities must still comply with charity law. We can provide tailored advice to exempt charities while being considerate of their unique regulatory position.

We bring a unique, direct appreciation of the regulatory pressures you face. Several members of our charities, not-for-profit and social enterprise team have experience from legal and regulatory roles at the Charity Commission.
Led by Graeme Hughes, who has practised exclusively in charity law since 2010, our specialist team is acknowledged by The Legal 500 as the leading group of experts in the North West, with a national reputation for providing tailored advice to charity trustees and interim managers on regulatory issues of all types.
All members of our team are recognised as leaders in their field, each drawing on experience acting for charity organisations of all shapes and scopes. As a purpose-led, B Corp-certified law firm with a unique passion for the third sector, we even have our own independent charity, The Brabners Foundation.
“Brabners has real expertise in charities and dealing with the Charity Commission. This is quite rare to find. Establishing a charitable publisher is hard, because there isn’t a clear line between what is charitable and what isn’t. Brabners did this successfully. Its fees are affordable by the sector.”
