Craig is a Partner in our litigation team. He receives instructions from insolvency practitioners in contentious insolvency matters.
Further, for over 14 years Craig has advised invoice factoring, trade and cash flow finance houses in respect of both recoveries and insolvencies of their default debtors.
He has significant experience in developing underwriting and post-default recovery processes for business-to-business lenders.
Craig advises on a broad range of litigation, for example:
- Acting for a trustee in bankruptcy to obtain an indefinite suspension of discharge from bankruptcy alongside an investigation into a bankrupt’s hidden income of c£20,000 per month, which resulted in a substantial income payments order.
- Various instances of advising former directors of companies in liquidation in respect of claims brought by the liquidators for preference claims and misfeasance.
- Acting for fixed charge receivers in contested possession and sale proceedings.
- Advising the administrators of a company in their response to a without notice injunction to prevent the sale of company assets and dealing with multiple claimants to the same charged assets with an estimated value in excess of £750,000.
- Acting for liquidators of a company in recovery of transactions made at and undervalue where the company had been ‘sold’ to an unregulated insolvency consultant in an effort to put assets out of reach of creditors.
- Recovering assets seized by police under forfeiture powers, after those assets were identified as assets belonging to the company in liquidation.
- Restraining presentation and advertisement of winding up petitions, as well as acting for the respondents to such applications.
