Outsourcing arrangements

More and more public functions have been outsourced by the public sector to private-sector contractors, with employees transferring under TUPE.  Pension rights are key to this process, as public-sector workers have pension rights on transfer that their private-sector colleagues do not.  The conversion of schools to academy status can also give rise to similar issues.

It is essential that the original transfer agreement is properly structured to reflect and protect both parties’ interests.  If not, unexpected and expensive costs can arise, or else staff can find themselves losing out on valuable pension scheme membership.
