Businesses, shareholdings and divorce

Businesses, shareholdings and divorce

Many of our cases involve family run businesses or complex company structures.

The business has often been set up by earlier generations and been inherited or gifted to a spouse prior to or during the marriage. Sometimes spouses have created the business together and whilst they recognise that they cannot continue to live and work together want to avoid damaging their business through contested divorce proceedings.

The extent to which pre-marriage owned or inherited company assets are taken into account by the divorce court requires very specialist advice as the law is not straightforward. Outcomes can depend upon difficult valuation and evidential questions. We have substantial experience in this complex area and are supported by our corporate and tax solicitors to make sure you get bespoke comprehensive advice.
