Prosecution and enforcement

Prosecution and enforcement

Environmental prosecutions brought against corporate bodies, businesses and individual company officers can be damaging, with significant financial and reputational consequences for the business.

We advise on a wide range of regulatory matters, in the fields of environmental and planning.

We have experience of advising clients in the immediate aftermath of serious incidents, from internal investigations and discussions with the regulator, preparation for and attendance at PACE interviews to any eventual prosecution brought by the Environment Agency, natural resources Wales, Natural England, the Police and Local Authorities, including representation at Court.

Our expertise includes, but not limited to, the following areas of practice:

  • Environmental Permitting
  • Pollution – land, air and water
  • Waste
  • Carbon Trading / EU ETS breaches
  • Statutory Nuisance
  • Planning
  • Countryside and Rights of Way
  • Habitat and species protection
  • Proceeds of Crime

We also regularly advise on Environmental indemnity disputes, particularly in relation to contamination issues, and on administrative law matters, including Judicial Review. We have also been successful in challenging environmental regulators on inappropriate use of, or interpretation of, their powers.
