Producer responsibility

Producer responsibility

Producer responsibility is an extension of the “polluter pays” principle and deals with the following areas:

  • Packaging waste
  • Waste Electrical and Electronic Equipment (WEEE)
  • Batteries
  • End of Life Vehicles (ELV)
  • Restriction of Hazardous Substances (RoHS)
  • REACH (Registration, Evaluation, Authorisation and Restriction of Chemical)

The requirements of the various Regulations are complex and it can be difficult for companies to determine whether they are obligated, and if so, to what extent.

Producer responsibility offences can carry large fines for a business in default, as well as significant reputational damage.

We have advised a number of clients on the availability of civil sanctions, such as Enforcement Undertakings and Variable Monetary Penalties, and we are able to negotiate with the Environment Agency to ensure the best possible outcome for your business.
