Climate and energy

Issues such as climate change and sustainable energy are increasingly on the government agenda and in the public eye.

As a result, energy producers, suppliers, distributors and developers face increasing scrutiny, legislation and regulation and, in turn, need accurate and practical legal advice more than ever before.

We advise upon all matters arising from Climate Change obligations, such as:

  • The Climate Change Levy and associated rebate agreements
  • The EU Emissions Trading Scheme (EU ETS)
  • Kyoto project credits
  • The Carbon Reduction Commitment (CRC)

Our expert advice covers a range of issues, including Environmental, Safety, Regulatory, Construction and Property and Corporate matters.

We advise industrial and commercial energy users on the on-site generation and off-site purchase of low carbon energy, with particular emphasis on the Ports sector.

We have extensive experience advising on Energy and Climate Change regulation. For example, we can advise on:

  • Interpretation of scheme rules and regulations
  • Licensing requirements (and available exemptions) under the Electricity Act
  • CCAs and LECs
  • The CRC (across all sectors)
  • Negotiations and discussions with the regulator
  • Compliance with the EU ETS and the allocation of and transfer and sale of allowances
  • Entry to the New Entrant Reserve
  • Defending prosecutions brought by the EA
  • Ofgem and DECC Consultations on the implementation of legislative changes (including the EU Third Energy Package)
  • Adjustments, applications and transfers required when businesses or sites change hands, start-up or close
  • Environmental issues (including site risk and renewable incentives relating to solar and onshore wind energy)
  • Procuring energy efficient/low carbon strategies and securing financial incentives and generation credits/tariffs (such as Renewable Obligation Certificates (ROCs), Feed-in Tariffs (FITS), and the Renewable Heat Incentive (RHI))
  • The Community Energy Saving Programme (CESP) and associated funding agreements
