Whistleblowing

Whistleblowing

Employees that are subjected to detrimental treatment and / or dismissed because they have ‘blown the whistle’ on legal breaches of public interest by their employer are entitled to bring claims in the Employment Tribunal, including for automatic unfair dismissal.

Damages for whistleblower claims are uncapped and can therefore be substantial. In addition, employers face the risk of severe reputational damage given that the Employment Tribunal is an open forum and such claims often attract press interest.

Brabners Employment Team is highly experienced in successfully handling whistleblowing issues for both employers and employees.

For employers we believe that prevention is better than cure and will help clients implement effective strategies for handling whistleblowing complaints. However, where a claim does arise we have the experience to successfully manage the situation through robust defence of Tribunal claims and dealing with reputational issues.

For employees, we have acted for numerous senior employees and executives in nationally reported cases, obtaining substantial compensation.
