Our commercial litigation team covers all areas of commercial litigation. We have specialist expertise in contentious probate, specifically the validity of wills and trusts and claims for the provision for dependents. 

We appreciate that issues arising around the validity of wills, or no will ever having been prepared (i.e. when the deceased died intestate), often come at a time when you may feel unable to deal with the matter.  We work with families, relatives and beneficiaries to achieve swift and cost-effective solutions to matters.

If you are concerned that there has been undue influence in the making of a will, or that there are issues stemming from a lack of capacity when a will was executed, we can assist you to investigate these issues sensitively and to advise on the options and remedies available to you to challenge the will.  If you feel that there should have been provision for you made in a will but that you are not referred to we can advise you on whether you can bring a claim for a reasonable provision to be made for you under the Inheritance (Provision for Family and Dependents) Act 1975.

If you are an executor or administrator of an estate facing these kinds of issues then we can assist you to examine the merits of any claims made against the will or the estate and assist you in complying with your duties.

Members of our team have extensive experience of all types of dispute resolution, including court proceedings, arbitration and mediation work.  Probate claims often involve proceedings in the probate registry and we regularly act on the process of lodging a standard search, caveat, warning and appearance.
