Whilst the majority of charities will be managed and administered in a harmonious way there can be occasions where significant disagreements can arise amongst a charity’s board of trustees, its members or both.

The vast majority of these disputes arise within charities with religious purposes and there are a number of examples in case law involving competing factions developing within religious organisations that ultimately require judicial intervention.

However, trustee and member disputes in all types of charities do occur. Such disputes can take a significant toll on those working and volunteering within a charity and deflect focus from the charity’s activities. In addition to this, there can be serious negative effects on a charity’s reputation where disputes spill out into the public domain.
