Governance matters for new and existing charities

Governance matters for new and existing charities

Good governance is paramount in any organisation, charitable or otherwise. Governance structures have to be effective in order to enable charities, social enterprises and not for profit organisations to compete in an increasingly challenging environment. Many funders for example now seek reassurances from charities that appropriate governance arrangements and safeguards are in place before entering into funding arrangements.

In addition to this, recent changes to the structure and focus of the Charity Commission have resulted in a number of regulatory interventions where poor standards of governance in charities have been brought into the spotlight.

For example, the Charity Commission concluded 1,972 operational compliance cases during the year 2013 / 2014 with a range of issues arising, such as the reporting of serious incidents, accounting issues, concerns about disqualified trustees and the misapplication of funds.

Our Charity Law solicitors have extensive experience in governance matters, keeping up to date with developments in law and good practice. We can assist in changes to your existing arrangements including the making of amendments to your organisation’s governing document, as well as in the development of policies to cover issues such as conflicts of interest.

Governance matters are also very firmly in our minds when advising upon:

Our Charity Law solicitors regularly speak on governance and related topics, and these issues can also be addressed as part of a bespoke trustee training session.

In addition, we would be happy to make arrangements to come into your organisation to discuss and consider the appropriateness of your existing governance arrangements, culminating in a full written report including our recommendations as to where improvements could be made.
