Dealings with the Charity Commission, including statutory inquiries

The Charity Commission, the regulator of charities in England and Wales, has become increasingly proactive in its regulation of the charity sector in recent years following criticism that it was no longer fit for purpose.

For example, the Charity Commission opened statutory inquiries into 64 charities between 1 April 2013 and 31 March 2014 compared to just 15 in the previous year and the Commission has been described by its chairperson as the sector’s “policeman” rather than its friend.

The Charity Commission has a wide range of legal powers that it can employ when investigating the activities of charities. It has a range of information gathering powers as well as both temporary and permanent protective powers that can be exercised in respect of individuals and a charity’s assets.
