Corporate partnerships

Many charities reap significant rewards from their partnerships with commercial organisations. For example, many commercial organisations engage with charities as their “Charity of the Year” or enter into promotional ventures whereby a percentage of the sale of a product is donated to a nominated charity.

In many cases, the entering into of arrangements by charities with commercial organisations will be what is known in legal terms as “commercial participation”. Commercial participation is quite heavily regulated with legal requirements set out in the surviving sections of the Charities Act 1992 and the Charitable Institutions (Fund-raising) Regulations 1994.

Our Charity Law solicitors have extensive experience advising upon the contents of agreements between charities and commercial organisations that satisfy these legal requirements, ensuring that amongst other things, the reputation and brand of a charity is protected.

In addition to this, many commercial organisations set up their own charities, commonly known as Corporate Foundations. Such Foundations are usually used as a vehicle for a commercial organisation’s charitable activity providing a means through which employees can become involved.

Our Charity Law solicitors have for example established corporate foundations for firms of solicitors, accountants, and sports clubs including Premier League football clubs, as well as advising many others.
