Success for Brabners Housing and Regeneration Team in Liverpool

Catherine Fearon, Associate in Brabners in Liverpool comments on the success that the team has had in court with Liverpool Mutual Homes:

The Housing and Regeneration Team had success on 15th August 2017 in court with Liverpool Mutual Homes (“LMH”), the tenant was represented by Driscoll Kingston and counsel David Bennett.  Following receipt of a letter of claim LMH instructed an expert to inspect the internal of the property, that expert advised some S11 repairs were required.  LMH made appointments for access, the tenant didn’t let them in on two occasions citing, on one occasion, that her solicitor had told her not to let the contractor in (sound familiar?)

The application for injunction was granted and an adverse costs order was made against the defendant. 

All round, a great result and those costs awarded can be offset against any damages payable or, the tenant’s solicitor may have to pay.
